This Study examines ways to strengthen implementation of the APEC Collaborative Framework for Online Dispute Resolution (ODR) of cross-border business-to-business disputes. It reviews progress to date, identifies key areas to expand uptake, and provides technical recommendations to improve implementation. It also considers the broader use of ODR in APEC, including in court systems.
The Study supports the APEC Economic Committee’s efforts to improve access to justice for micro-, small-, and medium-sized enterprises (MSMEs), which often face high costs and delays in resolving cross-border disputes. Building on the Collaborative Framework and Model Procedural Rules endorsed in 2019 and implemented since 2022, it draws on previous APEC studies, workshops, and policy dialogues.
