Study on Issues in Implementing the ODR Collaborative Framework and Using ODR in APEC Courts

This Study explores ways to improve the implementation of online dispute resolution (ODR) under the APEC Collaborative Framework for ODR of Cross-Border Business-to-Business Disputes (Collaborative Framework) by: (1) reviewing overall progress in implementing the Collaborative Framework; (2) discussing the benefits for APEC businesses and dispute resolution providers when economies opt into the Collaborative Framework; (3) developing strategies to help build capacity for partnering APEC ODR providers and encourage member economy businesses, including micro, small, and medium-sized enterprises, to use ODR through the partnering ODR providers; and (4) considering the application of ODR to business-to-consumer disputes. This Study also reviews the implementation of ODR in APEC economy courts.
