Intellectual Property Rights Experts' Group  

Intellectual property rights (IPR) protection and enforcement is a key factor for promoting foreign trade and investment, as well as for boosting economic development. In 1995, APEC recognized this fact and included this issue under the Osaka Action Agenda.

In early 1996, the Committee on Trade and Investment (CTI) established an Intellectual Property Rights Get-Together (IPR-GT) to ensure adequate and effective protection, including legislation, administration and enforcement, of intellectual property rights in the Asia-Pacific region based on the principles of the TRIPS Agreement and other related agreements. In August 1997, CTI reconstituted the IPR-GT as a sub-group with explicit terms of reference and renamed it the Intellectual Property Rights Experts' Group (IPEG).

The Intellectual Property Rights Experts' Group (IPEG) implements a work program which aims to -
  • Deepen the dialogue on intellectual property policy.
  • Survey and exchange information on the current status of Intellectual Property Rights (IPR) protection and administrative systems.
  • Study measures for the effective enforcement of IPR.
  • Fully implement the Agreement on Trade-related Aspects of Intellectual Property Rights (TRIPS).
  • Facilitate technical cooperation to implement TRIPS.

Achievements

IPEG concluded a four-day series of events in Lima, Peru held 20-23 February 2008. A common theme of the events was partnership and collaboration among intellectual property rights experts and enforcement authorities. The events began with a seminar on the topic of "Partnership in IP Protection." Intellectual property rights authorities and customs officials from 18 member economies participated in the seminar. Building on this foundation, the IPEG held its first joint session with the Sub-Committee on Customs Procedures (SCCP) on the subject of "International Cooperation in Border Enforcement for IPR Protection." Topics of discussion included "The Fight Against Counterfeit Pharmaceutical Products;" "Copyright Piracy in Traditional and Digital Media;" and "Counterfeiting of Brand-name Products."

In conjunction with these events, the Korean Intellectual Property Office and the Korea Invention Promotion Association exhibited the results of its APEC-funded project,
an "e-learning" program called "IP Xpedite" designed to increase awareness and utilization of IP information.

Drawing together intellectual property agency officials from around the Pacific, the IPEG workshop on "Using Market Research to Develop Effective IPR Campaigns" was held in Singapore on 12-14 December 2007. The workshop was aimed at helping APEC economies to improve research on public awareness and attitudes to IPR issues. The workshop was designed to help ensure that innovation is protected through the development of enhanced local awareness strategies.

APEC Anti-Counterfeiting and Piracy Initiative

In 2005, the APEC Ministers Responsible for Trade reaffirmed the important contribution of effective intellectual property rights protection and enforcement in promoting investment, spurring innovation and driving economic growth. They reiterated the need to build on APEC's work in this area. They urged APEC economies to take concrete steps to reduce trade in counterfeit and pirated goods, curtail online piracy, as well as to increase cooperation and capacity building. They endorsed the
APEC Anti-Counterfeiting and Piracy Initiative and instructed officials to intensify their work to develop the effective IP guidelines. They stressed the need to provide capacity building and encouraged exchange of experience to strengthen intellectual property protection and enforcement cooperation among member economies.

The APEC Anti-Counterfeiting and Piracy Initiative includes a range of measures that APEC members aim to implement. Four main goals are highlighted:

Reduce Trade in Counterfeit and Pirated Goods - Economies aim to reduce counterfeit and pirated goods trade and combat transnational networks that produce and distribute these items. Actions include establishing guidelines for authorities to inspect, suspend, seize and destroy goods and equipment used in counterfeit and pirated goods trade.

Reduce Online Piracy - Appropriate legal regimes and enforcement systems will be enacted to curtail online piracy and to undermine the online trade in counterfeit goods. This includes the development of guidelines to prevent Internet sales of counterfeit goods.

Increase Cooperation to Stop Piracy and Counterfeiting - Operational contact and the sharing of information between customs and law enforcement agencies will be increased to combat counterfeiting and piracy networks.

Increase Capacity Building to Strengthen Anti-Counterfeiting and Piracy Enforcement - Member Economies' ability to develop and manage effective anti-counterfeiting and piracy enforcement systems will be increased through education and training throughout the region.

With this mandate, the IPEG group has endeavored to establish IPR Model Guidelines. These include Model Guidelines
  • to Reduce Trade in Counterfeit and Pirated Goods
  • to Protect Against Unauthorized Copies
  • to Prevent the Sale of Counterfeit and Pirated Goods Over the Internet
  • for Effective Public Awareness Campaigns on Intellectual Property Rights
  • to Secure Supply Chains Against Counterfeit and Pirated Goods
  • to Strengthen IPR Capacity Building
IPEG continues to encourage APEC economies to put the model guidelines into practice, and continues to monitor the status of implementation.

Current Activities

In conjunction with its meeting in Lima, Peru in mid-August 2008, a Peru-sponsored seminar will be held on the topic of "Raising Awareness and Providing Policy Insights on promoting appropriate access and protection of genetic resources and traditional knowledge in APEC Economies."
